Article 1 – Definitions
Consumer:
An individual purchasing goods for personal use, not related to a trade or profession.
Business:
Evelyn Grace Boutique.
Distance Contract:
A contract formed exclusively through remote communication between the business and the consumer.
Final Sale Items:
All discounted, promotional, clearance, or sale-priced items.
Non-Returnable Products:
Items not eligible for physical return due to our international fulfillment process.

Article 3 – Scope
These Terms apply to all purchases made through the Evelyn Grace Boutique website by customers located in Canada.
Article 4 – Offers

Promotions and discounts apply only for the stated duration.
Article 5 – Agreement
An agreement becomes binding once the consumer completes checkout and receives an order confirmation via email.
Article 6 – Withdrawal Rights (Return Exemption)
Because Evelyn Grace Boutique uses international fulfillment centers and does not operate a physical return facility within Canada, the standard 14-day right of withdrawal does not apply.
This exemption covers:

Discounted or promotional items

Made-to-order or specialty items

Products fulfilled internationally
All such orders are considered final.
Article 7 – Non-Returnable Products
Due to our logistics model, physical returns are not accepted for the following situations:

Incorrect size

Change of mind

Delayed delivery due to shipping carriers

Duplicate orders placed by the customer

Final sale / discounted items

Orders placed with promotional codes
These orders are final sale and not eligible for refunds or exchanges.
Article 8 – Defective or Incorrect Items
If a product arrives damaged, defective, or incorrect:

The customer must contact us within 7 days of delivery.

Photo or video proof is required.

A resolution may include a replacement or store credit.

No physical return is required.
Refunds are only offered when a replacement is unavailable.
Article 9 – Customs Duties & Taxes
Orders may be subject to customs duties, VAT, or import fees upon entering Canada.
These charges are the responsibility of the customer and are not included in product pricing.
Article 10 – Delivery

Delivery times vary by region.

Most orders arrive within 5–10 business days.

Delays caused by carriers, customs inspections, or logistics operations do not qualify for refunds.

Once shipped, delivery timeframes are outside our control.
Article 11 – Complaints

Complaints must be submitted within 7 days of receiving the product.

Our support team will respond within 14 days.
Article 12 – Final Sale Clause
All sale items, discounted products, promotional purchases, and products bought using a discount code are final sale.
These cannot be returned, exchanged, or refunded.
Article 13 – Governing Law
These Terms are governed by the laws of Canada, specifically the province of Ontario.
Any disputes will be resolved in the competent courts located in Toronto, Ontario.
